FAQs for Blasting
-
The use and storage of explosives are governed by the Statewide Fire Prevention Code (SFPC). Enforcement of the SFPC may occur at the local level, typically through a designated fire official. In jurisdictions where the SFPC is not locally enforced, the State Fire Marshal’s Office (SFMO) serves as the primary enforcement authority.Important Information to Note:
-
The SFMO may investigate construction or blasting sites for potential violations of the SFPC. However, unless there is a clear and imminent threat to public safety, the SFMO does not have the authority to halt or suspend blasting operations. As a result, blasting may continue during or after an investigation, especially if the blasting company has implemented corrective measures.
-
The SFPC regulates the quantity of explosives used in relation to nearby structures. Blasters may also use seismographs to ensure that blast vibrations remain within legal limits.
-
If a blast results in property damage, personal injury, or death, the blaster must report the incident to the SFMO, in addition to fulfilling any other required notifications.
-
Contractors using explosives must hold valid permits, maintain insurance or bonding, and ensure that all blasters are certified by the Commonwealth of Virginia. The SFMO does not have the authority to require a contractor to compensate property owners for damages.
-
While violations of the SFPC may be addressed as criminal offenses, financial recovery for damages caused by blasting is considered a civil matter. Homeowners may seek compensation through their insurance provider or by consulting a private attorney.
-
-
If a blast causes debris to damage your property and your locality lacks its own fire official, contact the State Fire Marshal's Office (SFMO) at 804-371-0220.
-
The SFMO aims to respond within two business days.
-
Report the incident to your insurance company and avoid making permanent repairs until their adjuster arrives.
-
Temporary repairs may be necessary to secure the property, and it's important to document the damage with photos or videos.
-
Contractors carry insurance but may not automatically pay for damages; contacting the contractor directly and keeping all receipts for temporary repairs is advisable.
-
In case the contractor doesn't respond, your insurance company or a private attorney may help recuperate financial losses.
-
Review your homeowner's policy, especially the section on actions required after a loss, as failing to protect your property may void subsequent claims.
-
If you believe your insurance claim has been improperly denied, you can contact the State Corporation Commission (SCC) for mediation assistance.

The State Fire Marshal's Office (SFMO) investigates blasting complaints in areas without a local fire official, focusing on potential violations of the Statewide Fire Prevention Code (SFPC).Complaints can be made confidentially during investigations by contacting the SFMO at 804-371-0220 or statefiremarshal@vdfp.virginia.gov.Complainants should provide their contact information, details of the blasting operation, the company responsible, and a description of the complaint. Investigation records remain confidential until the conclusion, after which the complainant is notified and the records become public. The SFPC regulates the storage and use of explosives outside mining or quarry operations, which fall under the Virginia Department of Mines, Mineral, and Energy. The SFPC sets limits on ground vibrations and air blasts based on national standards, though these are not guaranteed to prevent damage. Regardless of adherence to these limits, building owners retain the right to pursue civil action against the responsible contractor or blaster if necessary.
